By accessing or using the FvrBox™ website, platform, or services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use our platform.
2. Description of Service
FvrBox™ is a digital memory-preservation platform that allows users to create secure “boxes” containing messages, photos, videos, audio, and documents (“Content”) to be shared with chosen recipients at a future date or event.
FvrBox™ is not a legal service, will, trust, or estate-planning platform.
Use of the platform for legal or inheritance purposes is entirely at your own discretion and is not legally binding in any jurisdiction.
3. Eligibility
You must be at least 13 years of age to use FvrBox™.
Users under 18 must have the consent of a parent or legal guardian.
By using the platform, you represent that all information you provide is accurate and that you have the right to upload and share the materials you submit.
4. Account Responsibility
You are solely responsible for maintaining the confidentiality of your account and for all activities under it.
FvrBox™ is not liable for any unauthorized access or activity under your account credentials.
5. Content Ownership and License
You retain full ownership of all content you upload to FvrBox™. By uploading, you grant FvrBox™ a limited, encrypted, non-exclusive license to store, display, and deliver your content solely for the purpose of providing the service.
We do not sell, rent, or distribute your content to third parties.
You agree that your content:
Does not infringe on copyright, trademark, or privacy rights.
Does not contain unlawful, obscene, or defamatory material.
FvrBox™ reserves the right to remove any content that violates these terms or applicable laws.
6. Privacy and Data Protection
Your data is encrypted and securely stored. While FvrBox™ employs industry-standard security practices, no online service can guarantee absolute protection.
By using the platform, you acknowledge and accept the inherent risks of storing digital data online.

7. Beta Testing and Feedback
During Beta, the service may contain incomplete features or technical issues. By participating, you agree to provide feedback and understand that the service is provided “as-is” without guarantees of uptime, functionality, or data retention.
FvrBox™ may modify or suspend features during testing without notice.
8. Payment and Subscriptions
Certain plans may require paid subscriptions. Fees are processed through third-party payment providers and are non-refundable, except where required by law.
Pricing and features may change with prior notice. All payments are final.
9. Data Retention & Deletion Policy
You may delete your account at any time. Upon deletion, your content will be removed from active servers within a reasonable timeframe, though encrypted backups may persist for up to 90 days.
FvrBox™ may retain limited metadata for audit or compliance purposes.
10. Service Availability & Continuity
We strive for continuous uptime but do not guarantee uninterrupted service. Technical issues, maintenance, or external events (e.g., cloud outages, cyberattacks, or natural disasters) may result in temporary downtime.
FvrBox™ is not liable for data loss or message delays caused by factors beyond our control.
11. Message Delivery & Timing Disclaimer
FvrBox™ delivers messages based on user-defined schedules. However, external factors such as email filters, recipient inactivity, or internet disruptions may cause delivery delays or failures.
FvrBox™ is not responsible for missed, delayed, or undelivered messages.
12. Deceased Account Policy
If an account is marked as belonging to a deceased user, FvrBox™ will preserve that user’s content as part of their digital legacy.
Once verified, the account will be locked for editing.
No new content may be added or modified after the user’s passing.
Assigned recipients will retain access to view the boxes and messages as intended by the creator.
FvrBox™ may request verification of death (e.g., obituary, death certificate) before changing account status.
This ensures that every FvrBox™ remains a lasting and unaltered digital memory after the user’s life.
13. User Conduct
You agree not to use FvrBox™ to upload, share, or transmit:
Illegal or harmful content
Malware or spam
Personal data of others without consent
Content violating intellectual property rights
FvrBox™ may suspend or terminate any account violating these conditions.
14. Inactive Accounts
Accounts inactive for more than 24 months may be archived or deleted after reasonable notice.
FvrBox™ is not responsible for verifying user activity or the status of recipients once an account becomes dormant.
15. Intellectual Property of FvrBox™
All trademarks, logos, interfaces, and code associated with FvrBox™, including The Forever Box, are owned by AG Marketing LLC.
Unauthorized use, reproduction, or imitation is strictly prohibited.
16. No Legal, Financial, or Emotional Guarantee
FvrBox™ is a personal memory-sharing tool, not a legal, financial, or counseling service.
We make no warranties regarding emotional outcomes or legal enforceability of any content or communication delivered through the platform.
17. Indemnification
You agree to indemnify and hold harmless FvrBox™, its affiliates, officers, and employees from any claims, damages, or expenses arising from:
Your use of the platform
Your uploaded content
Your violation of these Terms
18. Limitation of Liability
To the fullest extent permitted by law, FvrBox™ is not liable for any direct, indirect, incidental, or consequential damages arising from:
Loss or corruption of data
Service interruptions
Emotional distress
Failed or delayed message delivery
Unauthorized access to your content
Your sole remedy for dissatisfaction with the service is to discontinue using FvrBox™.
19. Force Majeure
FvrBox™ is not liable for failure or delay caused by circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, cyberattacks, government restrictions, or communication failures.
20. Modifications to Terms
These Terms may be updated periodically. Continued use of FvrBox™ after updates constitutes acceptance of the revised version.
21. Governing Law
These Terms are governed by the laws of the State of Florida, United States.
Any disputes shall be resolved in the courts of Polk County, Florida.
22. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FvrBox™, superseding all prior agreements or understandings.
